I'm writing to you because you are in a unique position to put an end to
modern-day debtors' prisons in Texas.
A traffic ticket should dissuade, but it should not destroy lives. And yet
all across the state of Texas, judges unconstitutionally jail low-income
Texans because they cannot afford to pay off the spiraling fines, fees,
and surcharges that result from traffic tickets. This is not only illegal,
but it also forces people to lose their jobs, their families, and their
futures.
I call upon you to support and implement the following reforms: 1) Require
judges to ask about ability to pay before sentencing; 2) eliminate unfair
court costs and fees (at a minimum, the warrant fee, the writ fee, and the
payment plan fee); 3) offer alternative sentencing; 4) end the Driver
Responsibility Program; and 5) eliminate jail as a punishment for overdue
fines and fees.
